JUDGING RULES

The following promotion is intended for viewing in the 50 United States and D.C. only and shall only be construed and evaluated according to United States law. Do not proceed in this site if you are not a legal resident of, and located in, the 50 United States or D.C. at the time of entry.

Progressive ModNation Gran Prix

OFFICIAL RULES

1. NO PURCHASE NECESSARY. MAKING A PURCHASE WILL NOT IMPROVE CHANCES OF WINNING. Void outside the 50 United States and D.C., and where prohibited by law. Must be 13 years of age or older must have access to a PlayStation^®3 system and a copy of ModNation Racers for the PS3™ system. You must also have a valid PlayStation^®Network account (“PSN ID”) and access to the internet. Contest begins March 01, 2011 12:01 AM, EST and runs through April 11, 2011, 12:01 AM EST. Entrants must download the Progressive parts pack for ModNation Racers via the PlayStation^®Network. Entrants will use the parts included in the pack to create their own track. Entrants must publish the track to the ModNation community. Please be sure to name the track “Pro_Flo_[Your Level Name]”. Entrants must include an image of ProFlo character or the Progressive Kart (included in the Progressive parts pack) on their created track as a condition of entry.
   All entries must be received no later than April 11, 2011 12:01AM, EST. Sony Computer Entertainment America Inc. (“Sponsor”) is not responsible for lost, late, mutilated, illegible, incomplete, postage due or misdirected entries. All entries become the sole property of Sponsor and none will be returned. In the event fewer entries are received than the number of prizes to be awarded, Sponsor reserves the right to take action as it reasonably deems necessary under the circumstances. In the event that fewer entries are received than the number of prizes to be awarded, Sponsor reserves the right to take action as it reasonably deems necessary under the circumstances. By participating, entrants agree to be bound by the Official Rules. Entries not satisfying these Official Rules will be automatically disqualified.
2. WINNER SELECTION / PRIZES: The ModNation Racer community will vote on which tracks they like. Levels are ranked accordingly. The ten (10) levels with the most votes from the community at the time the contest ends become the finalists. A panel of SCEA Judges will choose the Grand Prize winner and four (4) runner ups from the ten finalists. Decisions of the Judges are final. Grand Prize winner will be chosen on a basis of originality (40%), quality/polish (20%), brand awareness (10%) and creative use of items (30%). Winners will be notified via the e-mail account used in creating their PlayStation^®Network ID. Winners who do not respond within 14 days of notification will be disqualified. Sponsor will move down the list of community votes and select another runner-up. (If the person who didn’t respond was the Grand Prize winner, we will choose a different Grand Prize winner from the remaining four original finalists, then select a new runner-up from the community votes). One (1) Grand Prize winner will be chosen among all valid entries received. One (1) Grand Prize Winner will receive a 46” Sony Bravia 3D LED HDTV and PlayStation^®Move hardware bundle. (Approximate retail value: $2000.00).
   Four (4) Runner Up prize winners will each receive a PlayStation^®Move Sports Champions™ Bundle (approximate retail value: $100). Sponsor reserves the right to substitute a prize of equal value if prize is unavailable. Prizes are non-transferable and no substitutions allowed. Winners shall be notified by mail and/or telephone. Once notified, allow 6-8 weeks for delivery of prizes.
3. ELIGIBILITY: Contest open to legal residents of United States only who are 13 years of age or older at the time of entry. Employees of Sponsor and their respective parents, subsidiaries, agencies and affiliates and each of their related companies and their immediate families are not eligible to enter. Void outside the 50 United States and D.C., and where prohibited by law.
4. GENERAL: Grand Prize Winner may be required to execute and return an Affidavit of Eligibility and Release within ten (10) days of prize notification. Return of any prize/prize notification as undeliverable will result in disqualification and an alternate winner will be selected. If winner is a minor, then the Affidavit must be signed by winner’s parent or legal guardian and returned within the stated time period or prize may be forfeited. Winner(s) agree to the use of their name and/or likenesses for purposes of advertising, trade, or promotion without further compensation, unless prohibited by law. Additionally, winner(s) agrees to release Sponsor and their respective parents, subsidiaries, agencies, divisions, and affiliates from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in the Contest, or possession, acceptance and/or use or misuse of prize or participation in any Contest-related activity and claims based on publicity rights, copyright/trademark infringement, defamation or invasion of privacy and merchandise delivery. Neither Sponsor nor their respective parents, affiliates, subsidiaries, agencies, divisions nor related companies are responsible for any damages, or expenses that winners might incur as a result of this contest or receipt of prize. All taxes are the sole responsibility of the winners.
5. ODDS OF WINNING: Odds depends upon number of valid entries received.
6. WINNERS LIST: To obtain a list of winners, send a stamped, self-addressed envelope to: Progressive ModNation Grand Prix Winners’ List. 919 E. Hillsdale Blvd Foster City, CA 94404. Winners’ list requests will be fulfilled within four weeks after all prizes have been awarded. Requests for winners’ list must be received by May 11, 2011.
